Abstract
تتميّز علاقة الجريمة الاقتصادية بالأمن الاقتصادي بخصوصية متميّزة، حيث أصبحت الجريمة الاقتصادية في اطار العولمة الاقتصادية تشكّل قوّة مضادة لقوة الدّولة ذات الأثر المباشر على الأمن الاقتصادي الوطني والعالمي، حيث ترتّب عن تفشي مختلف أشكال الاجرام المالي والاقتصادي مخاطر اقتصادية، سياسية واجتماعية امتدّت خطورتها عبر الحدود الوطنية لتشكل عصابات اجرام اقتصادي دولي منظّم، اضافة لتفاقم ظاهرة الارهاب الدولي وتجدّد الأزمات الاقتصادية العالمية، وافسادالنّظام البيئي العالمي، الأمر الّذي أدّى لتدخّل الدّولةلاحتواء ذلك بتوظيف تقنيات الذّكاء القانوني من خلال تطويع النّظام القانوني للجريمة الاقتصادية وفقا لمتطلبات أمنها الاقتصادي بمراعاة خصوصية نظامها العام الاقتصادي سواء من حيث الركن الشّرعي والمادي والمعنوي وقواعد المسؤولية المترتبة عن الجريمة الاقتصادية، وتوسيع أليات اثباتها لتشمل الأليات التقليدية والمستحدثة، اضافة للجهات المختصة بالفصل فيها وصياغة شروط واجراءاتخاصة لمحاكمتها، وتنويع طبيعة العقوبات المترتبة عنها، وتنويعكذلك أساليب الوقاية منهاوالتي تعكس الارادة الحقيقية للدولة في مواجهةالجريمة الاقتصاددية بمختلف أشكالها وحماية أمنها الاقتصادي من خلال اجراءاتالرقابة بمختلف أشكالها لاسيما منها الرّقابة الدّستورية، والمالية ، والاداريةوالجبائية والسياسية ، اضافة لأليات أخرى وطنية ودولية متعدّدةلاسيما منها التّعاون القضائي والأمني الدّولي.

La propagation de diverses formes de criminalité financière et économique a créé des risques économiques. politique et social ", dont la gravité s’est étendue au-delà des frontières nationales en syndicats organisés de criminalité économique internationale, en plus d’exacerber le phénomène du terrorisme international, la reprise des crises économiques mondiales et la corruption de l’écosystème mondial, L’ordre qui a conduit à l’intervention de l’État pour contenir cela en employant des techniques d’intelligence juridique en adaptant le régime juridique de la criminalité économique conformément à ses exigences de sécurité économique pour prendre en compte la spécificité de son système économique public dans les termes juridiques, le pilier matériel et moral et les règles de responsabilité en matière de criminalité économique et l’extension des mécanismes de leur mise en place aux mécanismes traditionnels et émergents, ainsi que les autorités compétentes pour les juger et pour formuler des conditions et des procédures spéciales pour leur poursuite et la diversification de la nature des sanctions qui en découlent, ainsi que la diversification des méthodes préventives qui reflètent la volonté réelle de l’État de lutter contre la criminalité économique sous ses diverses formes et de protéger sa sécurité économique par des procédures de contrôle sous ses diverses formes, notamment le contrôle constitutionnel. les mécanismes nationaux et internationaux, y compris la coopération judiciaire et sécuritaire internationale.
